These Terms and Conditions (“Terms”) govern your access to and use of the emedalert.ai website, app.emedalert.ai mobile application, and related services (collectively, the “Services”). 3. Description of Services

app.emedalert.ai is a mobile application designed to automatically detect accidents and send instant alerts to emergency services (e.g., 112 in the EU), even when the user is unable to call for help. The application utilizes device sensors and algorithms to identify incidents such as falls, road accidents, or medical emergencies during activities like hiking or sports.

4. User Eligibility

You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

5. User License
We grant you a limited, non-exclusive, non-transferable, revocable license to use eMedAlert for your personal, non-commercial purposes. You may not copy, distribute, or modify any part of the Services without our express written permission.

6. User Responsibilities

  • Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.
  • Device Requirements: You are responsible for ensuring that your device meets the necessary technical specifications to use the Services effectively.

7. Health Disclaimer
eMedAlert is not a certified medical device. It is intended for informational and preventive purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider for medical concerns.

8. Notifications
By using our Services, you consent to receive notifications (SMS, email, or push) for emergency alerts and reminders. You may adjust your preferences, but disabling notifications may impact the effectiveness of the application. Standard messaging fees may apply.

9. Emergency Contacts
You are responsible for providing accurate emergency contact information. eMedAlert is not liable if incorrect or outdated contact data results in failed notifications.

10. Subscription and Pricing Policy
eMedAlert offers free and paid subscription plans. Prices are subject to change at our discretion. We reserve the right to modify, suspend, or discontinue any subscription or pricing plan at any time with or without notice. Any such changes will not affect active subscriptions until the next billing cycle.

11. User Content
You are solely responsible for the content you submit. You may not upload harmful, offensive, or unlawful material. We reserve the right to remove any content that violates these Terms.

12. Emergency Services Disclaimer

While eMedAlert.ai aims to enhance emergency response through automated alerts, we do not guarantee that alerts will be received by emergency services or that assistance will be dispatched. The effectiveness of the Services depends on various factors, including device functionality, network connectivity, and the accuracy of sensor data. Users should not rely solely on eMedAlert.ai for emergency assistance.

13. Emergency Response Limitations
We are not an emergency response service. If you are in immediate danger or require urgent help, call emergency services in your area.

14. Privacy and Data Collection

Our collection and use of personal information in connection with the Services are described in our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of your information as outlined in the Privacy Policy.

15. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are the exclusive property of eMedAlert.ai and are protected by intellectual property laws. However, we acknowledge that false or accidental alarms may occur due to various reasons, including but not limited to user error, device malfunction, or environmental factors.

19.1. No Liability for False or Accidental Alarms eMedAlert is not responsible for any false or accidental alarms triggered by users, devices, or other factors beyond our control. Our role is to facilitate the notification process, but we do not guarantee the absolute accuracy or validity of any alarm signal.

19.2. Role of Local Authorities In the event of an alarm, local authorities or emergency services may respond based on their own procedures and protocols. eMedAlert has no authority over their actions or decisions. Local authorities are responsible for assessing the situation and taking any necessary measures in response to an alarm.

19.3. User Responsibility Users are encouraged to familiarize themselves with the proper use of the eMedAlert system to minimize the risk of false or accidental alarms. Any misuse of the service may lead to consequences determined by local authorities.

19.4. Technical Measures While we strive to minimize false alarms through continuous monitoring and improvement of our technology, eMedAlert cannot guarantee the complete elimination of false or accidental alarms.

19.5. Agreement to Terms By using the eMedAlert service, users acknowledge and accept this disclaimer regarding false or accidental alarms. They agree that eMedAlert is not liable for any actions taken by local authorities in response to such alarms.

20. Limitation of Liability
